Waiver of Liability.

By clicking "I Agree", signing electronically, or otherwise acknowledging this Waiver and Release of Liability ("Waiver"), you agree to the following terms:

01Acknowledgment and Assumption of Risk

I understand that use of the facilities, equipment, and services provided by Pin High Golf Studio involves inherent and other risks, including but not limited to bodily injury, death, property damage, and other loss.

These risks include, without limitation:

being struck by a golf club, golf ball, rebounding golf ball, or other object;
slips, trips, and falls;
collisions with walls, screens, equipment, furniture, or other persons;
misuse or malfunction of simulator equipment, launch monitors, projectors, mats, balls, clubs, doors, or other facility equipment;
injuries caused by my own actions or the actions of guests, customers, staff, or third parties;
aggravation of a pre-existing medical condition;
risks associated with food and beverage service, including alcohol consumption.

I knowingly and voluntarily assume all risks, whether known or unknown, foreseeable or unforeseeable, related to my access to or use of Pin High Golf Studio and its services, premises, and equipment.

02Agreement to Follow Rules

I agree to follow all posted rules, policies, safety instructions, and staff directions. I understand that I must use the facility and equipment responsibly and only as intended.

I agree that:

I will wear proper clothing, including a shirt, bottoms, and appropriate footwear, at all times;
I will not engage in unsafe swinging, horseplay, abusive conduct, or improper facility use;
I will not share access credentials, door codes, or membership access with any unauthorized person;
I will be responsible for my guests and any minors under my supervision.

I understand that failure to follow facility rules may result in denial of entry, removal from the premises, suspension of access, or termination of membership or privileges without refund.

03Release of Liability

TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, I HEREBY RELEASE, WAIVE, AND DISCHARGE PIN HIGH GOLF STUDIO, ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, CONTRACTORS, REPRESENTATIVES, AFFILIATES, SUCCESSORS, AND ASSIGNS FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, ACTIONS, CAUSES OF ACTION, LOSSES, COSTS, OR LIABILITIES ARISING OUT OF OR RELATING TO MY ACCESS TO OR USE OF THE FACILITY, EQUIPMENT, SERVICES, OR PREMISES, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF PIN HIGH GOLF STUDIO OR ITS OWNERS, EMPLOYEES, AGENTS, CONTRACTORS, OR REPRESENTATIVES.

I understand that this release applies to claims for personal injury, death, property damage, and other loss to the fullest extent allowed by law.

This Waiver does not release claims that cannot lawfully be waived.

04Damage Responsibility

I accept full responsibility for any damage to the facility, equipment, or property caused by my actions, my misuse, my negligence, my failure to follow instructions, or the actions of my guests or minors under my supervision.

I authorize Pin High Golf Studio to charge the card on file or otherwise seek reimbursement for repair, replacement, cleaning, administrative, or related costs resulting from such damage.

05Medical Condition and Emergency Care

I represent that I am physically and mentally capable of participating in simulator golf activities, or I knowingly choose to participate despite any condition or limitation.

I understand that Pin High Golf Studio does not provide on-site medical care. In the event of illness, injury, or medical emergency, I authorize Pin High Golf Studio to seek emergency medical assistance on my behalf if deemed appropriate, and I accept responsibility for any resulting medical costs.

06Minors

If I am agreeing to this Waiver on behalf of a minor, I represent that I am the parent or legal guardian of that minor, or that I otherwise have legal authority to act on the minor's behalf.

I acknowledge and agree that:

any minor must be accompanied by a responsible adult at all times while on the premises;
I accept responsibility for the minor's supervision, conduct, and safety;
I accept responsibility for any damage, injury, or loss caused by the minor;
the minor and accompanying adult must comply with all Pin High Golf Studio rules and policies.

07Indemnification

I agree to indemnify, defend, and hold harmless Pin High Golf Studio, its owners, members, managers, employees, agents, contractors, representatives, affiliates, successors, and assigns from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorney's fees, arising out of or related to:

my conduct at the facility;
my violation of facility rules or policies;
damage caused by me, my guests, or any minors under my supervision;
any claim brought by or on behalf of my guests or a minor associated with my booking or access.

08Surveillance

I understand and acknowledge that Pin High Golf Studio uses 24/7 video surveillance for safety, security, incident review, and operational purposes.

09Governing Law and Venue

This Waiver shall be governed by the laws of the State of Texas. Any legal dispute arising from this Waiver or my use of Pin High Golf Studio shall be brought in a court of competent jurisdiction in Hidalgo County, Texas, unless applicable law requires otherwise.

10Acknowledgment

By clicking "I Agree", I acknowledge that:

I have read this Waiver carefully;
I understand its contents;
I understand that I am giving up important legal rights;
I agree to be bound by its terms voluntarily.
